GENERAL CONDITIONS OF THE SCOOTER RENTAL CONTRACT WITHOUT DRIVER

USE AND CONDITION OF THE SCOOTER

The customer receives the scooter described in the contract in perfect condition, including working order, tyres, and accessories. The customer undertakes to maintain these and to operate the scooter in compliance with traffic laws and in accordance with the specifications for the type of scooter. Only the person(s) identified and accepted by Lucky Rent A Scooter S.L. in the rental contract are authorized to drive the scooter.

It is prohibited:

• The use of the scooter on roads that are not paved or not officially authorized.
• Altering any technical and/or physical characteristic of the scooter, including keys, equipment, tools, and/or accessories.
• Performing any repairs on the scooter without the express authorization of the lessor.
• Transporting the scooter aboard any other type of vehicle.
• Leaving the territory of the Autonomous Community of Andalusia, with the exception of scooters with an engine capacity of 350 c.c. or higher, which may leave Andalusia solely for the purpose of entering and exiting Gibraltar.
• Transporting passengers for remuneration.
• Pushing or towing other vehicles or any other object, whether wheeled or not.
• Participating in competitions, whether official or not.
• Operating the scooter under the influence of alcohol, narcotics, or while in a physically impaired condition due to fatigue, illness, or medication.

AMENDMENTS TO THE RENTAL CONTRACT

• These General Terms and Conditions, as well as the remaining clauses of the rental agreement, may only be amended by mutual written agreement signed by both parties.
• If the cancellation is made with more than 48 hours' notice, 100% of the amount paid for the reservation will be refunded.
• If the cancellation is made without notice or within less than 24 hours, taking into account the company's business hours for receiving such notice, Lucky Rent A Scooter S.L. reserves the right not to issue any refund of the amount paid.
• Lucky Rent A Scooter S.L. shall not be held responsible for weather conditions.

PRICE, DURATION AND EXTENSION OF RENTAL

• The rental price is the amount stated in the rental agreement and is determined in accordance with the current General Tariff.
• The rental price includes the cost of compulsory liability insurance, legal protection, personal accident insurance for the driver, and roadside assistance. The deposit will only be refunded once Lucky Rent A Scooter S.L. has verified that the terms and conditions of this contract have not been breached.
• A surcharge of €35 will apply for service provided outside of regular business hours.
• The deposit will be refunded using the same method of payment used at the start of the rental, unless exceptional circumstances require a bank transfer.
• The deposit paid at the beginning of the rental period may not be applied toward an extension of the rental period. Any extension must be approved in advance by Lucky Rent A Scooter S.L., and the customer agrees to pay the corresponding additional amount immediately.

PAYMENTS

The customer is responsible for the following charges:

• The tariff and services stipulated in the rental contract.
• Any fines resulting from traffic violations.
• In the event that Lucky Rent A Scooter S.L. personnel are required to travel to a municipal impound facility to recover a scooter that has been confiscated due to irresponsible driving or parking, the customer shall be responsible for a €50 fee, as well as all towing charges and any fees associated with the time the scooter remains impounded.
• The cost of any damage and/or theft, whether partial or total, to the scooter, as specified in the DAMAGE CHARGES TABLE.
• If the customer has only contracted the Basic Insurance, the maximum liability will be limited to the amount specified for the respective scooter model in the BASIC INSURANCE TABLE.
• If the LUCKY Insurance has been contracted, the customer will only be liable for the applicable excess amount as specified in the LUCKY INSURANCE TABLE, according to the scooter model.

SCOOTER INSURANCE, THEFT, DAMAGE AND BAIL

• The rental price includes third party liability insurance, personal accident insurance for the driver, and roadside assistance.
• It does not include coverage for theft, total or partial loss, or damage to the scooter or its luggage and/or contents, whether caused by vandalism or traffic accidents.
• The customer shall bear the cost of any damages in accordance with the scooter model as specified in the DAMAGE CHARGES TABLE, with the maximum liability limited to the amount set out in the BASIC INSURANCE TABLE.
• If the LUCKY Insurance policy has been contracted, the scooter will be covered against full theft, damage resulting from attempted theft, fire, collision, overturning, malicious acts by third parties, and weather-related events. The customer will be responsible for damage as per the DAMAGE CHARGES TABLE, up to the excess amount indicated in the LUCKY INSURANCE TABLE based on the scooter model. This excess will be deducted from the deposit paid. To benefit from this coverage, the customer must provide the scooter key, a correctly completed accident report, and/or a police report, as applicable.
• The customer releases the lessor and the insurer from any liability—except as covered under the contracted insurance—for any physical or material damage resulting from both normal and improper use of the rented scooter. The customer expressly acknowledges awareness of the inherent risks associated with scooter use.

ROADSIDE ASSISTANCE

In the event that the scooter becomes undriveable or fails to start, the customer must contact the lessor to request roadside assistance. The customer agrees not to abandon the scooter and must remain with it until the arrival of the tow truck or an authorized representative.

The full towing fee will be charged to the customer in the following cases: improper use of the scooter; loss or breakage of keys or helmets; lack of fuel or incorrect refuelling; recovery of the scooter from locations and/or unpaved roads unsuitable for driving; or any other error, negligence, or misuse of the scooter by the customer.

FUEL

The customer must return the scooter with the same level of fuel as when it was delivered. No refunds will be issued for any excess fuel added by the customer. The required fuel is 95-octane gasoline. The customer shall be held responsible for any damage caused to the scooter resulting from the use of incorrect or unsuitable fuel.

INCIDENCIES

In the event of an incident, the customer must immediately contact the lessor and submit a correctly completed accident report. The customer must not abandon the scooter and must take all appropriate measures to protect and safeguard it. Any summons, writs, or notifications related to the incident must be promptly forwarded to both the lessor and the insurer. The customer agrees to fully cooperate with the insurer in the investigation and defence of any claims or legal proceedings and to file a police report if required by the circumstances.

EARLY TERMINATION OF THE CONTRACT

Any breach of the terms and conditions of this contract by the customer shall entitle the lessor to terminate the contract with immediate effect. In such cases, the lessor may demand the immediate return of the scooter without any obligation to refund the customer for the unused rental days.

COMPUTER PROCESSING OF PERSONAL DATA

The customer authorizes the automated processing of the personal data provided in this contract, as necessary for the execution of the agreed services, as well as for the offering and contracting of other products and services provided by Lucky Rent A Scooter S.L. The customer is hereby informed of their right to access, rectify, and, where applicable, request the deletion of their personal data by sending an email to customerservice@luckyrentascooter.com.

APPLICABLE LAW AND JURISDICTION

This contract shall be governed by and interpreted in accordance with the laws of Spain. Any disputes arising in connection with this contract between Lucky Rent A Scooter S.L. and the customer shall fall under the jurisdiction of the Spanish courts and tribunals corresponding to the city in which the contract was signed, to which both parties expressly submit.
